Marcus M. Sixta

Marcus M. Sixta is mediator and arbitrator based out of Calgary and Vancouver. He is a highly regarded and award-winning family lawyer recognized as one of Canada's top 25 most influential lawyers and named to the prestigious Best Lawyers list.
Marcus has extensive training and experience in mediation and is an accredited family law mediator in British Columbia, a registered family mediator in Alberta, and also a certified collaborative divorce lawyer. Marcus has a passion for helping families in crisis and his legal career was profoundly influenced by his background as a social worker.
Marcus employs a flexible, person centered approach to mediation. He tailors his mediation style to suit the needs of the parties to optimize collaboration, increase opportunities for resolution, and maximize efficiency. Marcus may adopt a facilitative approach, guiding discussions while providing space for different perspectives, or an evaluative approach, assessing options from a legal standard and providing guidance on the path to resolution.
Marcus also believes that accessibility is key to access to justice, and he regularly conducts mediations by video conference across B.C. and Alberta, and with or without lawyers representing the parties.
In Alberta, Marcus also arbitrates disputes and is available for combined mediation/arbitration proceedings in which he acts initially as a mediator, but if resolution in mediation cannot be achieved, he may make a binding decision that is enforceable in court. The arbitration process may be customized to the meet the needs and objectives of the parties and this includes many options such as limiting the process to affidavit evidence and written argument, or even a process analogous to a trial at court with cross examination and oral arguments.
Mediation can be a transformative process for separating families and Marcus aims to move families beyond conflict and into more stable and healthy relationships. He believes that mediation should result in resilient, family-centered outcomes that are cost-effective and equitable for all involved.
